You may cancel your booking before the Start Date shown in your Agreement and receive a refund of your Advance Rent Payment and any rent payments you have made to us where:

• your UK visa application is refused and, as a result, you cannot come to the UK to study; or
• you do not achieve the grades required for your university place and, as a result, you are not accepted by your university.

To cancel under this section, you must email the Residents’ Team as soon as reasonably possible and normally within 48 hours of receiving the relevant decision or evidence.

You must provide reasonable evidence with your cancellation request. This may include a visa refusal letter, a university rejection letter, UCAS evidence, exam results or other official evidence that we reasonably accept.

This cancellation right only applies where the visa refusal or failure to achieve your university place happens before the Start Date shown in your Agreement.

If you do not tell us or do not provide reasonable evidence within a reasonable time, we may be unable to accept your cancellation under this section. In that case, your Advance Rent Payment and any rent liability will be treated in line with these Booking Terms and your Agreement.

This section does not apply if you decide not to continue with your studies, withdraw from university, change university, change course, defer your studies, decide not to move in, or are excluded or removed from your course after being accepted.

There is no automatic cancellation period after your Agreement has been signed by you, any required Guarantor.

Once your Agreement has been signed by all required parties, it is legally binding. You and, where applicable, your Guarantor will be responsible for the payment obligations set out in your Agreement and these Booking Terms.

If you decide not to move in, change your mind, withdraw from university, change university, change course or leave early, this does not automatically cancel your Agreement or end your payment obligations.

You will only be released from your Agreement where:

• these Booking Terms say that you are entitled to cancel;
• your Agreement says that you are entitled to end it early;
• we accept a suitable replacement resident and they complete a new agreement;
• we re-let your room; or
• we agree to release you in writing.

If we re-let your room, your liability for future rent will end from the date the replacement agreement starts, subject to any unpaid sums, rent shortfall or reasonable costs caused by your breach.

We will not recover rent twice for the same room and the same period.
